Cannabinoids, as a group, have had an uncertain legal status for a number of years. This is rapidly changing, however. On December 20, 2018, the Agriculture Improvement Act of 2018 (2018 Farm Bill, PL 115-334) was signed into law federally. The legal definition of hemp is the Cannabis sativa L. plant with a THC concentration of less than 0.3 percent, by dry weight. Anything above 0.3 percent THC is essentially classified as "marijuana" and is federally illegal, although some states have legalized all forms of cannabis.

In the United States, we are governed by local, state and federal laws. These laws, and their practical enforcement, may vary from state to state and municipality to municipality. There may be situations where local agencies have not updated their laws to remove CBD from their ban of Schedule 1 drugs to date. With the demand of cannabis-based products growing globally, it appears to simply be a matter of time before laws are updated nationwide, allowing for significantly decreased restrictions around cannabinoid consumption. If you are concerned about the legality of a cannabinoid product you are considering, we recommend that you ask for a Certificate of Analysis to be sure you know what you are getting and consult with your medical provider before consuming any product.

The Formula30A product line is only sold through licensed medical professionals. You will not find any of our products sold through eBay, Amazon, or any other retail outlets, as we believe that patient education on endocannabinoid system, and how full-spectrum extracts interact with this system, are vital. This includes how cannabinoid consumption may interact with some prescription drugs or other medical conditions that can affect treatment plans. As a result, Formula30A only allows patients to purchase cannabinoid products through Formula30A-approved, licensed medical professionals.

There are numerous ways manufacturers can extract CBD from the hemp plant. Typically, hemp is extracted using a solvent, such as alcohol, ethanol, butane, or propane, which can destabilize the extract. The most popular form by industrial extractors is CO2 (carbon dioxide), which claims to be safer than alternative solvents and easier to scale for large amounts of CBD production.

At Formula30A no herbicide, pesticide or toxins ever touch our hemp plant during our entire process from farm to final capsule. We get a clean organic hemp plant that was grown in clean Colorado Soil by artisan growers who understand cannabis. So when it came down to extraction, we needed a way that stood up to our standard of pure, clean, and simple. Formula30A hemp oil is processed using a patented water-based extraction process adapted from one first used by the Egyptians thousands of years ago. This allows us to obtain a beautifully clean full-spectrum hemp extract, with all the phytocannabinoids, terpenes, and flavonoids in tact.

Further studies are warranted to examine the potential long term effects of solvent-based extraction processes. Your first and best source of information is your medical provider. Products in the CBD market that are currently available vary greatly in their formulations, extraction processes, delivery methods, additional ingredients, and potency testing. Further complicating matters, different "classes" of cannabinoid formulations - isolate, broad spectrum, and full spectrum - have been demonstrated differences in overall product efficacy.

Formula30A CBD contains 25mg of solvent-free, full spectrum cannabinoid extract with organic coconut oil in vegan capsules. Based on anecdotal reports from medical providers recommending Formula30A in the practices, as well as Formula30A's recently completed observational studies, one (1) daily 25mg capsule of Formula30A CBD is the suggested starting dosage for most patients. Due to the nature of the Cannabis sativa L. plant, this question is very important to understand for patients and providers alike. Hemp is highly absorbable and uses a process called phytoremediation to absorb and remove heavy metals and toxins from the soil. It has been used for thousands of years to clean the soil and is an important tool in crop rotation a more nutrient rich soil. While many companies provide you with a test for potency of their hemp extract, it may be even more important to know what is not in your hemp extract. A common problem with industrial hemp is the presence of herbicides, pesticides, toxins, residuals, heavy metals and mold, all of which can make their way into the end product.

Formula30A uses a patented water-based extraction process, and our hemp flower only goes through this process once, which is why it is important that we test the hemp flower for potency directly from our state approved organic hemp farmers. That way we are assured that our hemp flower meets the federal <0.3% threshold for THC and does not contain toxins and heavy metals. Once the hemp flower goes through our extraction process, the oil is tested again to determine potency of the CBD compound in our oil. Finally, we submit our encapsulated Formula30A to a 3rd party independent laboratory, where potency and purity are confirmed, as well as the omission of toxins, heavy metals, residuals and mold.

Formula30A cannabinoids are created using full-spectrum hemp extract. In addition to key components such as CBD or CBG, there are over 100 other naturally occurring compounds present in our products, including trace amounts of THC (less than 0.3% by dry weight, as determined by US law). Employers commonly use standard urine tests to identify illicit substances in the urine. As most of these types of tests are geared towards identifying THC, rather than CBD or other cannabinoids, trace amounts of THC in legal full spectrum cannabinoid products may register as a failed drug test. More accurate tests, such as blood tests that can measure THC from hemp versus THC from marijuana, can help to prevent false positives where available.

If you are consuming any cannabis product that claims to be THC-free or Isolate, it is strongly recommended that you consult with your physician. According to a 2020 study performed by the FDA, 45% of CBD products tested contained the amount of CBD advertised (within ±20%). Even more worrying, 49% of products test had THC levels that exceeded the legal limit for hemp extracts. We recommend that you always ask for a certificate of analysis and confer with your medical provider before consuming any cannabinoid product.

Hemp (the legal term for the Cannabis sativa plant with less than 0.3% THC content by dry weight) has over 100+ phytocannabinoids of which CBD, CBC, CBG CBN and THC are just to name a few that have been identified and studied. There are additional naturally occurring compounds called terpenes and flavonoids which are believed to have therapeutic effects in full spectrum extracts. During extraction for Full Spectrum hemp oil, the whole plant flower is used, maintaining the plant's balance of cannabinoids, terpenes, and flavonoids. According to studies from Israeli biochemist Dr. Raphael Mechoulam, who has studied the endocannabinoid system throughout his career, the whole plant creates an “entourage effect” in the body, with greater efficacy when all the parts of the plant are maintained during the extraction process of the oil.

On the other hand, the Isolate extraction process attempts to remove all these phytocannabinoids, flavonoids, terpenes and isolate only the cannabidiol compound (CBD) into what is defined as a CBD isolate. In a study done by researchers in 2015 in Israel, they found that the single-molecule CBD administration created a bell-shaped-dose-response curve with a narrow therapeutic window. These studies showed that when CBD exceeded a certain point its therapeutic impact declined dramatically. This is not the case with full spectrum hemp extract, as the compounds work synergistically together to create the anti-inflammatory response desired.

Cannabidiol (CBD), one of over 120 different phytocannabinoids derived from the Cannabis sativa plant, is one compound under investigation for its reported anxiolytic and anti-inflammatory effects, as well as its ability to reduce symptom severity with insomnia and chronic pain. Lacking the widely known and often controversial psychoactive effects of ∆9-tetrahydrocannabinol (THC), research on cannabidiol has demonstrated symptom relief for a wide range of disorders, due in some part to its effects on activity in limbic and paralimbic areas of the brain and receptors throughout the body.

CBD also has an excellent safety profile with limited adverse effects compared with other available treatments.¹⁸ However, while popular belief holds that CBD is a relatively benign substance, clinical evidence shows that there is a potential for drug-drug interactions. Given the wide availability of products containing CBD on the market today, from tinctures to coffee additives, this underscores the necessity for medical supervision of CBD intake and formulation-specific clinical research.

Some biological interactions, and their related potential therapeutic benefits, include:

  • Activating 5-HT1A Serotonin Receptor: Helps with anxiety, addiction, appetite, sleep, nausea, vomiting
  • Binding to TRPV1 Receptors: Moderates pain, inflammation, body temperature
  • Activating Peroxisome Proliferator Activated Receptors (PPARs): Has been shown to produce anti-cancer effect and help with Alzheimer’s
  • Blocking G Protein Receptor GPR55: May decrease bone reabsorption and the spread of cancer cells

If you want to ensure that you are consuming a clean organic hemp extract, make sure you ask where your hemp is grown. With the passing of the 2018 Farm Bill and cannabis industry growth projected to top $20 billion by 2024, many state legislatures are passing laws to benefit from this profitable trend. What were once fields of tobacco crops in states like Kentucky are now moving to a more profitable field of hemp plants.

As farmers and consumers are finding out, this plant is not just another crop and not all hemp sources are equal. The quality of consumable products created from hemp grown in Europe, China, or Australia, initially bred for paper, fabric or rope, can vary widely. However, according to the FDA, even this standard is often broken; 49% of products sampled by the FDA in 2020 contained THC levels above the legal limit.
